Personal Injury Law Overview

Personal Injury Law Overview
If you have suffered physical injury or have been scarred mentally due to an accident or negligence on the part of another person or party then you can sue the opposite side under the personal injury law. However, the law along with legal recourse varies in different countries and hence it is important that you engage the services of an efficient lawyer or attorney to represent you in case you have suffered in an accident caused by negligence of others.

In the United States, a claim under the personal injury law can be filed in case a ‘tort’ has occurred when you are on the property of a person and suffer an accident that occurred because of negligence on the part of the other person. If the other person or party has failed to post adequate warnings then you could still file for a claim under this law. There are several types of claims that come under the tort umbrella such as various types of medical malpractices resulting in physical and mental harm, auto accidents, slipping or tripping leading to injury, assault including sexual assault, accidents caused by faulty products or lack of warnings, accidents caused on holidays, etc. However, personal injury laws in the US are quite complicated and might also require experts to interpret it clearly, especially in medical malpractice cases where the case might require experts from various medical and legal fields to lead to a plausible conclusion.

You can sue not only for the physical pain and mental anguish caused by the accident but also claim for loss of future earnings that would have been cut short due to the accident. In addition you can claim your medical expenses caused by the accident and in select cases also sue for punitive damages. In the US, you can hire an attorney based on a contingency basis formula, where your attorney will take away an agreed percentage of the monetary compensation that you receive when you win the case. You can also try to enter into a “No Win, No Fee” arrangement where you will not have to pay any money in case you lose the case. However, not all attorneys might agree to such an arrangement, while others might ask for an upfront cash advance that can later be adjusted when you win the case.

In other countries such as Australia, there are several types of claims that come under the purview of personal injury law such as motor accident injuries, public accidents, industrial accidents and worker compensations, accidents that result in death, etc. Again, advice from an experienced attorney is important since you not only need to file a claim but also win it, and this can only be done with adequate preparation and knowledge of each aspect of the personal injury law in great detail. In the US there are various time limits known as Statute of Limitations that will need to be studied so that you file your claim within the prescribed time limit, based on the state in which you need to file your claim. This period is roughly between one to six years based on the state, while the rules are different for minors. In the UK, the rule is to file your claim within three years while in Australia it is between three to six years depending in which state or territory the claim is filed.

There are several complications and interpretations within the personal injury law. Depending on which country you reside in or have suffered an accident in, you will need to follow the rules of that state or country so that you have a better chance of winning your claim. An efficient and experienced attorney that is considerate to your needs and allows for flexible payment terms should provide you with the best opportunity to win your claim at the earliest.
